Crime Meets Criminality: Human Nature or Inhumanity?

Sometimes, I think that humans, are birthed with the tendency to commit crimes and engage in forms of criminalities. Most times, I end up brushing off the thought because I have met people who are true definitions of humanity. Judging by recent happenings, I concluded that we have more percentage who are inherently wicked and evil. This claim is not far-fetched as it is evidently seen in the story of Abel and Cain.

It saddens my heart and brings tears to my optics when I see the high rate of crimes in this century. Once in a while, I wish to take an investigative journey to the past centuries to understudy if crimes were these high then. Rapes, murders, racism among other crimes are being reported almost everyday. All these social vices want me to question where humans humanity and tolerance have gone to?

The past days have been virtually eventful, but sadly, for negative reasons. In these past days, we have heard and read of killings, rape and murder. But the cases that stood out were that of a teenager who was 'mistakenly' murdered in cold blood, a lady who was brutalised a a result of rape and a black man who suffered the consequence of being black.

Police brutality is something not new to Nigerians. The numbers of those killed in the first two weeks of the lock down were more than the total that were  killed by the Coronavirus. Police's insatiability for corruption can not be imagined. They can do anything when their illegal requests are  not attended to by drivers. But what I could not come to terms with is why would a supposedly law enforcement agent fired a gun carelessly: something that should not be done by civilians like me. Many results of the police brutality and rash decisions have been reported in recent times. The most recent of such brutality and senseless shooting was that of Tina Ezekwe. Tina who was a teenager was hit by a police officer's misfire shot at Iyana Oworo area of Lagos state. I will like to see it as a murder case  rather than a case of manslaughter. Tina at the time of her death was aged 16 and due to sit for her WAEC examination this year. Yes, I called it a case of murder because nothing gave the police officer the reason and audacity to rashly and unreasonably fire. I would not want to start imagining the state the girl's parent would be at this time. We keep hearing young minds are the leaders of tomorrow, but it seems to me  that everything is being coordinately put in place that the paradigm never comes to fruition. An example should be made out of the police officer in question so as to serve as a deterrent to other trigger- happy police officers.



Rape cases have been prevalent, not only in Nigeria, but also all over the world in recent times. Those who religiously follow international updates would give an acceptable nod to this claim. Hardly would a day pass without at least a reported case of rape. Nigeria stands among countries recording cases of rape in recent times. In a report, it was said at least a girl child is raped everyday in Nigeria. But the rape case of Uwa serve as one of the backdrop for writing this piece. I find it unbelievable that the victim was raped and brutalised inside a church! The late Uwavera Omozuwa was a 200-level Uniben student who had decided to take the church a reading centre as a result of this covid-19 pandemic when all institutions are under lock and key. As her usual habit, the late Uwa on Saturday, May 30 decided to visit her reading base which was a redeemed church for another reading session before she was pounced on by vagina-hungry predators. She was badly raped and brutalised. I will rather not focus on the fact that the criminal, disgusting and ungodly act was carried out inside a church as the perpetrators may be infidels or atheists, not that I have problems with them being infidels or atheists as everyone is entitled to his/her beliefs. But I will rather focus on the inhumanity displayed by these individuals. Another rape case involving 14 men raping a young girl was reported in Jigawa this morning. There is nothing we can call that  than it is an act of wickedness. I hold the opinion that more stringent laws should be passed on any cases involving rape. Many women are raped and they have to live with the stain and stigma for the rest of their lives. Some are not strong enough, they would rather take solace in murder. There should be no place in the world where women will feel insecure as right to life  and property is one of the fundamental human rights. As a result of consiszent reports of rape cases, many women would leave their homes in fear of being way laid or raped. In this Uwa's case, humanity has definitely gone on an expedition of no return.

Humanity decided earlier this week to take another break when an innocent man suffered the consequence of being born black. The current event has generated reactions all over the world. Since the occurrence of the incident, nationwide protests have been going on in the United States of America. George Floyd suffered a tragedy of police brutality in Minneapolis, Minnesota in America not because he was asked for bribe or refusing police arrest or shot at a police officer, but because he was black. His death was just that of circumstances birthed by the world we live in. Racism has been around for as long as I could remember and many have kissed the mother earth as victims of racism. A sneak peek to books like Native sons, Sizwe Bansi is dead, Second class citizen and a host of other  negro oriented work of arts: prose, poetry and drama will sharpen one's mind and take one on a long memory lane. Africa was blindly looted by whites for more than a hundred years. Even after independence, we are still enslaved by their Ideas. Years after breaking the shackles of imperialism and colonialism, Africans still struggle for acceptability. The White see black as nobody, especially, in the White man's land. It is the highest degree of inhumanity to kneel on someone's neck and others present would just derive pleasure in the whole scenario by laughing away. Even after pleading for his dear life, they didn't bulge. George Floyd's offence was that he was black. I find it nauseating that people judge by  colours. Nobody holds any decision on the colour he would be birthed. I was born black not because I had a choice, but because I was lucky to be born black. You were born White not because you had a choice, but because you were lucky to be born White. I think the United Nations Organisation should try everything possible to put an end to any forms of racism around the world. As a result of racism, Africans live in fear of being abused, maligned and marginalised because of the colour of the skins. The protests in America that have sent the United States' president to the white house bunker should send a strong message to other countries what racism can cause and that being black is not an aberration.

NELOC News: Can we meet you sir?

Guest: I am an Indian cyber security expert, trainer, author, mentalist and 24 year old entrepreneur. I am the founder and CEO of Aezowie Infotech Services Private Limited, a company that provides network security, application development and designing services to corporations. NELOC News: How does I.T and Cyber security define entrepreneurship for you?

Guest: Right now, the cyber security related business is growing drastically and cyber entrepreneurship is a new source of economic growth and development. I love Cyber security and from childhood I wanted to be like Steve Jobs. He is my motivation. So Cyber Security & Entrepreneurship is a perfect combination for me.
 

NELOC News: How did your journey into Cyber Security begin?

Guest: Most individuals go straight out of college into the cybersecurity field with degrees in computer and information science or other technical degree programs. But my journey began when I developed my first computer software during my school days in class 11th. The next year, I failed in my class 12th Board Exams but that did not deter me as I was buoyed by the success of my software. It’s a long story but in the end I turned out to be a successful owner of my own company.

NELOC News: Recently, Twitter was hacked and accounts of prominent persons were compromised. How does this affect Cyber security for other users?

Guest: These kind of incidents occur not because of account hacking but due to user hacking. In our field, we call it social engineering. See, humans are the weakest point in the cyber world. In this recent case the hackers did not use their access to target any major institutions or infrastructure — only asking for Bitcoin, instead. But the attack concerned security experts because it suggested the hackers could easily have caused far more havoc.

 

NNI: In leading an I.T Company, what is leadership to you? Is leadership a mix of different skills?

Guest: For me leadership means understanding, motivating and organizing other people to reach a shared goal. Whether you are in a management position or leading a project, leadership skills require you to motivate others, often on schedule, to complete a series of tasks. Leadership is not just one skill but a combination of several different abilities that work together.

NNI: In what ways have you managed leadership positions with other duties?

Guest: I believe everything is connected and there is no professional or personal work/thing. I just enjoy what I am doing and due to this mindset, things become easier for me.

NNI: Are there any laws determining the legality of Computer Viruses? To what extent are these Viruses legal?

Guest: Well distributing a virus to others is against the Law. The Computer Misuse Act is the law which covers this area. In the United States also, the distribution of a virus that affects computers used by government or by financial institutions is a federal crime under the Computer Fraud and Abuse Act. But making a computer virus isn't against the law. However, if that virus spreads deliberately or by mistake to other computers, you have breached the law and you could be held liable for any damages it causes.

NELOC News: We are facing the reality of a completely digital world. Does this mean an increased breach in data security? To what extent is this breach and how can it be curbed?

Guest: Over the last few years we have seen a drastic change in how individuals and businesses use technology to achieve their objectives. According to a global survey by the Ponemon Institute and IBM Security, the average probability that an organization will experience a data breach has increased to 27.7 percent compared with last year's 25.6 percent. With digital transformation, everything became easier, more accessible and less time consuming but for sure probability of data breach is also increasing with it. I think the best weapon to fight with this is the knowledge and awareness.
 

NELOC News: In your opinion, can we achieve a fully cyber secured world?

Guest: Frankly speaking, it is impossible because the most secure system is the one that is never built. So basically everything is hackable, but it’s depends on how much time, money and resources someone is ready to invest to do so. If you really wanted to make your data 100% safe, you would have to back it up to a hard disk, disconnect it from any computer, put it in a safe, and then bury the safe in an unknown place. Only then could you be rest assured that the information was safe from hackers.

NNI: How do national (India and any other countries) and international legislations affect cyber security?

Guest: Most nation’s cyber laws are pretty strong whether you talk about India or any other county but the problem is that our legal system and police force don’t know much about how to deal with cyber criminals. So firstly our governments need to ensure that these people will be well educated about cyber security and related issues. And yes strong international legislations are very much required because in the cyber world there are no boundaries between nations. Within this global cyber security culture, enhancing security and ensuring data protection and privacy while enhancing access and commerce is important.

NNI: What is your advice to individuals and youths especially who have interests in cyber security and the IT space?

Guest: I think with an ever-expanding scope, cybersecurity presents the ultimate potential for growth, both in your career path and for opportunities to learn. Practically, cyber security is the field of unlimited growth but to become an expert in this field you need to understand that it is not the certifications or college degree that makes you an expert. Any individual who wants to become a good cybersecurity professional must focus to understand the inner mechanism of technologies and organizations as much as possible. Remember experts persevere and they focus. Security experts are no different.

Top 5 Nigerian Myths about Peptic Ulcer

Peptic ulcer, known as ogbe inu in Yoruba, onya in igbo, and miki in hausa, can be simply defined as sore of the gastrointestinal tract (GIT) or digestive tract lining, the stomach and the upper part of the small intestine especially. Although the prevalence of peptic ulcer in Nigeria is not exactly known yet, chances are that you know someone or you know someone that knows someone with stomach ulcer, which is the commonest type of peptic ulcer. However, there is still so much misconception around this disease. Let us take a look into some of them.
 

1. Skipping breakfast/fasting is the primary cause of Ulcer

Having breakfast regularly is a healthy practice, yet skipping breakfast is not the primary cause of ulcer. The stomach normally produces some acidic juices to aid food digestion. The lining of the GIT, however, is protected from the effects of the stomach juices. If these protective mechanisms get compromised, the acids can work on the walls of the digestive tract and ulcerate them. Recent studies have shown that the bacteria, Helicobacter pylori, which is introduced into the stomach and intestine through contaminated food and water, and coming in contact with contaminated fluids like saliva, poses a major threat to the integrity of the GIT walls and hence the primary cause of ulcer.

2. Eating some kinds of food can cause Ulcer

Many believe that eating a lot of peppery and acidic food can make one have peptic ulcer, but that, as far as research is concerned, is incorrect. The only type of food that can lead to the ulceration of your GIT is contaminated food, as earlier discussed. Peptic ulcer patients are advised to stay off spicy, rocky, and highly acidic food not because that was what caused the ulcer, but because their stomach walls are already injured and eating those foods will worsen the pain.

3. Peptic ulcer has no Cure

This is a myth you've probably heard  more than once. Yet, studies show that peptic ulcer can be cured if diagnosed early and treated properly. The first step in treating ulcer is identifying the cause and getting rid of it. Giving antibiotics against Helicobacter pylori have been proven to be an effective treatment for peptic ulcer. They can be used alongside proton pump blockers, which reduce the amount of stomach acids being secreted. Moreover, a group of drug known as non-steroidal anti-inflammatory drugs (NSAID), or simply put, painkillers, like aspirin and ibuprofen, if used regularly, can compromise the integrity of the GIT walls. Desisting from the use of these drugs can therefore be the first step in treating some ulcers. When these treatments begin early, are strictly adhered to and properly followed up, peptic ulcer can be cured, many of the times.

4. Overeating can cure Ulcer

People who eat regularly have lesser chances of having ulcer because whether your stomach is full or empty, it still produces acidic secretions. These secretions tend to work on the stomach walls when there’s no food in the stomach, hence an acidic environment makes the GIT more prone to ulceration. However, this is only a secondary cause of ulcer, as the digestive tract naturally has means of protecting its lining. The primary cause still needs to be taken away. So, overeating does not cure ulcer. It might make the patient feel better for a while. In extreme cases even, overeating can constipate the ulcer patient. This is why people with peptic ulcers are not advised to overeat, but to eat regularly.

5. Peptic ulcer is not a serious Disease

Many people feel peptic ulcer is a disease that anyone can endure for the rest of his life, so long his cupboard is filled with painkillers or herbal medicines. Well, it's true that many times, symptoms of peptic ulcers tend to be mild at the onset, however, in the long run, if causative agents aren't properly dealt with, ulcers can get serious and lead to internal bleeding and eventually death. In fact, in the World Health Organization (WHO) data published in 2020, Nigeria was ranked Nigeria as #31 out of countries with high death rates from peptic ulcer. Peptic ulcer is indeed a serious disease, and treatments should be sought for as soon as possible.

5 Healthy Eating Tips for Nigerian Pregnant Women

You are what you eat. However, when you are pregnant, you are not only what you eat, your baby also is. Studies have shown that the fetus derives everything needed for its growth and survival, from the very moment of conception to the very moment of birth, from its mother. This includes nutrients, fluid, oxygen, and antibodies. Thus, we can never overemphasize how important it is to eat healthy as a pregnant woman, and you know what? Doing this doesn’t have to be burdensome. Here are 5 tips that would bring you closer toward achieving your healthy-eating goals and maximizing nutrients from available foods as a Nigerian pregnant woman.

1. Start your day with a healthy breakfast

Starting your day with a healthy meal when pregnant doesn’t only energize you, and of course your baby, for the day, it has also been observed to reduce the chances of you feeling hungry every single hour of the day, and that’s a good thing. As you continue reading, you’ll come to understand why that’s good, but for now, let’s get a glimpse of what a healthy breakfast should look like. Really, it’s not far-fetched. A healthy breakfast should span across all, or almost all the classes of food. So, you might want to consider easy combinations like bread and egg with home-made orange juice, or moin-moin(bean pudding) and pap/ eko(solid pap), or even your regular fortified cereal with a lot of milk, and then one apple. Any energy-rich, protein-containing, mineral-and-vitamin-including diet works just fine. Make sure you get enough water too. Other pregnant women in the bid to “eat for two” would make sure their mouths are busy all day. The danger of the former is that if you don’t eat well enough, your baby won’t get enough nutrient and can end up being underweight, and in extreme scenarios, the baby can die prenatally. Meanwhile, the danger of the later is that both the mother and the baby can become obese, and this can cause complications, and eventually lead to death. The solution, however, is to eat well, but not overeat. Having a healthy breakfast, like I’ve earlier stated, is one way to achieve this. Also, have a healthy lunch and dinner; experts advise that you should consider spreading your lunch, and even dinner, over 2 or 3 servings, rather than eat a large portion at once. Taking a lot of water all through the day helps too and if you ever feel like munching on something else during the day, you might want to consider healthy snacks, which leads us to the next tip.

Consider healthy snacks.

It’s very possible that even after having a good meal for breakfast and drinking just enough water, you still feel like snacking on something before your next lunch or dinner serving. However, rather than go for junk food that would provide your baby little or no nutrient and would only make both you and your baby gain unnecessary weight, consider healthy snacks. The best and cheapest form of healthy snacks still remain handy fruits like bananas, apples, oranges, watermelons etc. You can try fruit salads too. Youghurt as well has been proven to be a very nutritious snack for pregnant women as it contains fibres, calcium and other vitamins that are necessary for both your health and your baby’s growth. You can also consider other snacks rich in protein, vitamins, and minerals like smoothies, fruit parfaits, fruit-rich cakes, egg scrambles etc.

Every class of food plays a role in the proper growth and development of your baby. From carbohydrates and good fats that supply your baby with energy to proteins and minerals that provide a building block for your baby’s developing organs to even vitamins and water that allows the other nutrients to be properly utilized, your baby needs them all. Since no single food has been found to contain all the nutrients your baby needs, you need to make sure your diet is as varied and balanced as possible, from animal proteins to whole grains to legumes and to even fruits and vegetables. If for any reason, you don't eat some kinds of food, you need to find alternatives to getting the nutrients those food contain, and this might involves creating weekly or monthly meal plans that help you ensure you’re getting an adequate amount of every nutrient your baby needs. Creating the plan with someone, maybe your husband, or a friend could make the process more fun, and if you are particularly allergic to some kinds of food, then you should consider involving your dietician or doctor. 

Finally, eat clean.

Eating healthy is not just about eating right but also eating clean. Hence, you have make sure your fruits and vegetables are fresh, and avoid stale or pest-infested food. Also, make sure your fruits and food ingredients are properly washed before you use them. In addition, ensure that your food is always properly cooked. Avoid over-cooking vegetables as this can rid them of the water-soluble vitamins B and C. Make sure your meats are thoroughly cooked too. Basically, just make sure you eat clean.

NNI: Can we meet You?

Guest: My name is Yemisi Ajeojo,  author of “Social Media is your new CV” a book where I shared how I have  gotten amazing opportunities from social media and how anyone can position themselves online for amazing opportunities. From what to share, how to connect with the right people to how to use Linkedin, the book covers it all. I am also the co-founder of Triift Africa, a social enterprise that provides easier access to low interest loans, business support and advisory. 

In addition, I am the co-founder of Cirkle Labs a digital social enterprise Leveraging on community and collaboration to influence education, enterprise and employment at the grass root level with digital tools. NNI: Kindly tell us about your book, ''Social Media is Your New CV''

Guest: I will always remember moving back to Nigeria in 2017 filled with a lot of uncertainties because almost everyone that heard that I was coming back had made sure to remind me of the unemployment statistics in Nigeria.

So, imagine my surprise when I got over 5 job offers in less than 2 weeks from people that I had met on social media. In addition to job offers, I have gone on to receive an invitation to speak at Tedx, speak at other amazing events and even sponsorship for some of the community projects  I have done from people I only met on social media. I wrote this book to share what I did right with other young people.

Majority of young people are on social media, and these platforms provide access to a  lot of opportunities and that is why I wrote this book.

I shared not just my story, but the story of other amazing people I know who have gotten job opportunities and even scholarships just by connecting with the right people  the right way and sharing the right content online. In my book, I have shared how anyone  can achieve this too.

NNI: How can you leverage on opportunities that digital media provides?

Guest: When you continue to develop skills, and acquire knowledge that adds value to the community, as well as clearly communicate this value on digital platforms and intentionally engage with the right people you will find it really easy to leverage on opportunities that digital media provides. 

NNI: What views do you hold as regards social media strategy?

Guest: A social media strategy whether as one created for an individual or business goes a long way to create an intentionality with being online and having a voice.

NNI: It is really strange how the older generation believe social media cannot earn one a living. What are your comments about this?

Guest: I don’t think it is strange, to a large extent we are only familiar with what we know. The job market is changing, 10 years ago or even 5 years ago a lot of the jobs that exist now with digital tools did not exist then. So, imagine growing up thinking that the only key jobs that provide financial security is to be a doctor, accountant, engineer or lawyer. But now you have a daughter or son who just sits all day with a laptop and earns money by working for  companies in countries  he/she has never been to. I can only imagine how hard it is to come to terms with.

NNI: What was your first experience as a TEDx Speaker?

Guest: I had the opportunity to speak at the first Tedx that took place in Bowen University in 2018. There are different ways to be a Tedx speaker, but the first thing is to have a message you want to share and be sure that you can share it as articulately as possible within a short period of time, maximum 12 minutes. This is very easy to achieve with practice. You can put yourself forward to speak at a Tedx event or just make sure that everyone around you knows the things you are passionate about and you would like to share this knowledge at Tedx event. That way, people are able to recommend you for opportunities when they arise.

NNI: What would you say is the biggest lesson failure ever taught you?

Guest: Failure has taught me to never define myself by a happening at one point of my life. That it didn’t go well today doesn’t mean I do not have a life to leave tomorrow.

NNI: What motivates you?

Guest: I am really result driven and passionate about making social impact. 

The poverty rate in Nigeria is very alarming . Each time I watch the news, it is like a big weight has been put on my shoulders  and I am staring at a ticking time bomb that will affect me and generations to come if I do not put my own effort towards addressing it.

The Rule of Law: The Order of Justice

THE MILITARY GOVERNOR OF LAGOS STATE V OJUKWU AND ANOR.

The facts of the case are as follows.
On October 10th 1985, Emeka Ojukwu (respondent) made an ex-parte application at the High Court of Lagos state before Omotosho J, he sought an injunction restraining the Military Governor of Lagos state, the Commissioner of Police Lagos state and The Attorney General of Lagos state from ejecting him (Ojukwu) and his family members from No 29 Queens Drive Ikoyi, to which he referred to in his application to the Court as his house.
The interim order which Ojukwu sought from the court was only meant to operate for a specific time pending when the issues before the court would be determined. Ojukwu affixed an affidavit in which he swore before the High Court that the house belonged to his father after whose death he inherited the house.
He further deposed on oath that during the civil war which lasted from 1967-1970 where he led the Biafran army against Nigeria, the house was unoccupied all through the war and although the war ended in 1970 he only came back to Nigeria from exile in 1982 after he had been granted full pardon by the Federal Government of Nigeria. Ojukwu moved back to the house after having paid the sum of ninety thousand naira to the Lagos state government for "expenses incurred by the said government in keeping the house", and also that all members of his family had been residing in the house before the case at hand was instituted before the court.
The trial Judge granted the interim order for injunction on the grounds of his ownership of the house and the looming fears of the government evicting him. The matter then moved to one of notice to the Lagos state government, Ojukwu would then change his words. He now said that the property belonged to Ojukwu Transport Company which was owned by his late father and that the ninety thousand naira was paid to agents who were in charge of the property for the purpose of securing a lease of the property.
The trial judge refused equitable relief of injunction against the Lagos state government on the ground that the property is an abandoned property and that Ojukwu failed to sufficiently prove that he had a legal right to or interest in the said property. In conclusion the learned Trial judge asserted that Ojukwu himself had not come to equity with clean hands.
After this case was decided at the trial court and judgment given an application was made by Ojukwu Transport Company as an interested party in the case asking for leave to appeal against the judgment of the high court and also an application by Ojukwu that he be reinstated at his residence No 29 queens Drive Ikoyi. The court paid attention to the prayer of the appellant and particularly frowned at the fact that the Lagos state government evicted Ojukwu from his residence despite the fact that his application was pending before the Court of Appeal, this action the state government termed "self-help", the court came to the conclusion that the right to self-help ended when the issues came before the court, the court then ordered that Ojukwu be reinstated into the property.
It is noteworthy however to point out that the Lagos state government refused to comply with the order of the court of appeal The order was made on 13th November 1985 and was in the following terms -
(ii) "Pending the determination of the appeal of the applicant against the said decision, against the respondents and in favour of the applicant an order of mandatory injunction restoring the applicant in his residence at No. 29, Queen's Drive, Ikoyi, Lagos, and restraining the respondents and all their officers, servants, agents, and functionaries from evicting or taking any steps to evict the applicant from his residence at No. 29 Queen's Drive, Ikoyi, Lagos."
Rather than comply with the order of the court the Lagos state government appealed on November 22nd to the Supreme Court on the ground that "the remedy of interlocutory injunction is not available for an act which has been carried out and concluded"
Basically what this argument meant was that the act which the interlocutory injunction was sought against had been carried out already by the Government when it made ordered about  one hundred and fifty men in arms to evict the appellant, or  Or to put 'it in more legal form, carried out as a way to forestall the decision of the Court of Appeal against which an appeal is now being lodged to this Court (Supreme Court) The Lagos state Government then applied to the court of Appeal seeking an order pursuant to section 18 of the court of appeal Act for a Stay of execution of the mandatory injunction granted to Ojukwu.
Kolawole J.C.A. delivering the ruling of the Court of Appeal said inter alia -
"If the appeal of the State Government is successful the respondent can be ejected by due process of law. In this regard Chief Williams has shown magnanimity by offering an undertaking in damages by way of rental income if the State Government is successful in its appeal.
In that regard no stay would be granted. Learned Attorney-General contended before us that as Chief Ojukwu is a trespasser at 29 Queen's Drive Ikoyi, the State Government is not prepared to accept any undertaking in damages in the form of rental income from him."…..
Having regard to the status of irremovability acquired by Ojukwu after the judgment of this Court, it follows that the Lagos State Government is not entitled to a stay of execution because it never made out any special circumstances upon which to grant the stay. (See Keaves v. Dean (1924) 1 K.B. 685 at 686). The prayer for stay of execution is therefore refused and the application is dismissed."
In the same Court, Ademola J.C.A. in a concurring ruling, said- "This Court in an earlier ruling had taken the view that it was wrong to eject the respondent by force under the doctrine of self-help.
The Lagos State Government still failed to comply with the order of the Court of Appeal. And I think it is this dreadful situation that prompted Chief F.R.A. Williams S.A.N. learned counsel for Ojukwu to file his notice of preliminary objection dated 11th December. I have already set out this notice earlier on in this Ruling. We heard the two applications together.
Mr. Adelosoye the learned Solicitor General for the Lagos State pleaded for a restoration of the status quo ante the judgment of the High Court. He said Ojukwu had been in occupation for 10 months before the Lagos State Government got to know of his occupation.
Chief Williams for his part emphasized the deliberate disobedience of the order of the Court of Appeal by the Lagos State Government and that that Government was in contempt of the Court of Appeal.
I think it is a very serious matter for anyone to flout a positive order of a court and proceed to taunt the Court further by seeking a remedy in a higher court while still in contempt of the lower court.
It is more serious when the act of flouting the order of the court, the contempt of the court, is by the Executive. Under the Constitution of the Federal Republic of Nigeria, 1979, the Executive, the Legislative (while it lasts) and the Judiciary are equal partners in the running of a successful government.
The powers granted by the Constitution to these organs by s.4 (Legislative powers) s.5 (executive powers) and s.6 (judicial powers) are classified under an omnibus umbrella known under Part 11 to the Constitution as "Powers of the Federal Republic of Nigeria".
The organs wield those powers and one must never exist in sabotage of the other or else there is chaos. Indeed there will be no federal government. I think, for one organ, and more especially the Executive, which holds all the physical powers, to put up itself in sabotage or deliberate contempt of the other is to stage an executive subversion of the Constitution it is to uphold. Executive lawlessness tantamount to a deliberate violation of the Constitution.
When the Executive is the Military Government which blends both the Executive and the Legislative together and which permits the Judiciary to co-exist with it in the administration of the country, then it is more serious than imagined.
By virtue of the Constitution (Suspension Modification) Decree 1984 No. 1 a good number of the provisions of the Constitution were suspended. Indeed, what was left was what had been permitted by the Federal Military Government to exist.
All the provisions relating to the Judiciary were saved. Section 6 of the Constitution, the most important provision, in so far as the institution known as the Judiciary is concerned, which vests in courts the judicial powers of the Federation was left extant. The Military Government had the power and still has to put an end to the existence of that provision, It has not done so, and that must have been advisedly for it does intend that the rule of law should pervade.
That being the case, it behoves of every organ of the Military Government to make it clear at all times, albeit as the presumption is always that of rule by might of the military, to assume a perennial onus of demonstrating a rebuttal of this onus.
With the contempt of the Court of Appeal by the Applicants still subsisting, it would he inequitable for this Court to give a consideration to the application of the Applicants. Let the Lagos State Government purge itself of this serious contempt, of this apparent violation of the Constitution even as amended by Decree No. 1 of 1984 before coming to seek the favour of the Court.
Another very important matter emanating from the act of the applicants. They have no right to take the matter into their own hands once the court was seized of it. The essence of rule of law is that it should never operate under the rule of force or fear. To use force to effect an act and while under the marshal of that force, seek the court's equity, is an attempt to infuse timidity into court and operate a sabotage of the cherished rule of law. It must never be.
It is for these reasons that I dismissed the application of the applicants- The Military Governor of Lagos State, the Commissioner of Police Lagos State and the Attorney-General Lagos State on 11th December 1985 and so be it.  JUSTICE KAYODE ESO J.S.C

Cogent decisions on points of law in the case by the learned Justices of the Supreme Court are affixed below:
OBASEKI J.S.C on The Doctrine of Rule of law
"The Nigerian Constitution is founded on the rule of law the primary meaning of which is that everything must be done according to law. It means also that government should be conducted within the frame-work of recognized rules and principles which restrict discretionary power which Coke colourfully spoke of as 'golden and straight metewand of law as opposed to the uncertain and crooked cord of discretion' More relevant to the case in hand, the rule of law means that disputes as to the legality of acts of government are to be decided by judges who are wholly independent of the executive. See Wade on Administrative Law 5th Edition p. 22-27. That is the position in this country where the judiciary has been made independent of the executive by the Constitution of the Federal Republic of Nigeria 1979 as amended by Decree No. 1 of 1984 and No. 17 of 1985. The judiciary cannot shirk its sacred responsibility to the nation to maintain the rule of law. It is both in the interest of the government and all persons in Nigeria. The law should be even handed between the government and citizens."
UWAIS J.S.C.:
I had the advantage of reading in advance the reasons for ruling read by my learned brother Eso, J.S.C. I entirely agree with the reasons given by him. When we dismissed this application on 16th December, 1985, I expressed my concern on the failure of the applicants to comply with the order made by the Court of Appeal that the possession of the house in dispute should be restored to the respondent. I think I should still stress that it is a matter of grave concern that the Military Government of Lagos State should be seen to disregard a lawful order issued by a court of law. If Governments treat court order with levity and contempt the confidence of the citizen in the courts will be seriously eroded and the effect of that will be the beginning of anarchy in replacement of the rule of law. If anyone should be wary of orders of court it is the authorities; for they, more than anyone else, need the application of the rule of law in order to govern properly and effectively. It is for these and the fuller reasons given by my learned brother Eso, J.S.C. that I dismissed the application on 16th December, 1985 with N25.00 costs to the respondent.

He graduated from Covenant University with a degree in Information and Communication Technology in 2007.  He was featured in Pulse Magazine as number one on the list of "Top 12 Musicians To Look Out For in 2014".

9. Bimbo Ademoye

Abimbola Aisha Ademoye professionally known as Bimbo Ademoye was born on February 4, 1991, in Lagos State where she grew up with his father after the parents went separate ways when she was 2-years-old. She is a Nigerian actress, model well known for her role in the Nollywood movie Backup Wife in 2017. Bimbo Ademoye Being that she grew up in Lagos, she attended St. Margarets Primary School, Ikorodu, Lagos, and Mayflower Secondary School, Ikenne, Ogun State for her primary and secondary education. She proceeded to Covenant University, Ota where she obtained a degree in Business Administration in 2016.

10. Etinosa Idemudia

Etinosa Idemudia is a Nigerian actress, social media influencer and film maker was born on 9th March, in Warri Delta. In 2011, she obtained a Bachelors Degree in Computer Engineering. In 2016, She also attended other schools like Royal Arts Academy, Lagos Nigeria owned by Emem Isong where she obtained Diploma in performing Arts. She is best known for her online comedy skits which she began producing and sharing, first on her instagram channel featuring various Nollywood actors including Daniel K Daniel. She is also known for her break-out role as Amanda in the sitcom Chairman and her first feature film production The Washerman, which after the release of its trailer, experienced massive anticipation from her fans.

I Used the Bible to Clean My Buttocks - Pastor Hezekiah Olujobi

Pastor Hezekiah Olujobi is the convener of the CJMR. In this interview, he leads us through his walk in prison, his salvation story and the "Bible-buttock tale"

 

 

NELOC News: Can we meet you?
Guest: I'm Pastor Hezekiah Olujobi. I was born on August 8, 1963 to a Christian family. My mum was a junior sister to Late Apostle Ayo Babalola, the man whom God used for the revival in Nigeria and Africa in 1930. I was also ordained as Pastor  in Christ Apostolic Church in 1995. I'm happily married with Victoria Mojisola Olujobi, a father of four children, the Director and Coordinator for Centre for Justice Mercy and Reconciliation, a Christian non Governmental Organisation based in Ibadan, Oyo state, Nigeria with focus on the welfare of people languishing in Nigerian Prisons in Awaiting Trial and on Death row without a just cause.


NELOC News: What inspired the CJMR?
Guest: The vision of CJMR was born from my personal experience as an ex inmate who had gone through the process of prison incarceration for six consecutive times in 3 different Prisons in Nigerian. I had my encounter with the Lord Jesus Christ during my detention period for six years in Agodi prison on 16th August, 1989 and I gained my freedom on 3rd of March, 1993 (I was remanded in the prison on 27, January, 1987 on allegations of armed robbery) over an offence I knew nothing about. After my freedom, I decided to proceed to the Bible school but very unfortunately I was turned down because I didn't have school cert. I later opted for another Bible school for Evangelist and Prophets which had no extra condition or requirements other than your calling.  Shortly after I completed my one year training, I was posted to Pastor a church and I was ordained as a Pastor. Two years after my ordination as a Pastor and as Pastor of a church with fast growing number, I heard a voice from the Lord who instructed; "Go back to where I called you to go and bring out others who are still walking in the darkness. For this reason I have caused you to walk in the darkness so that you may bring the captives to the knowledge of saving grace". This was my entry point to the ministry.

At the initial stage I did not have full concept of what the ministry will look like than to go to the prison and preach, but along the line, the purpose of the ministry unfolded itself. I visited prisons and in the cause of my interaction with many of them who were later released, I realised that the same problems that I faced were the same factors responsible for their cycle of incarceration. I decided to provide them a room in my 3 bedroom apartment at the time. I identified their problems and I moved to solve them. In that process, I saw the need to advocate for many of them who had no lawyer. I connect them with some Christian lawyers who offered them free legal services, especially those detained without case files in the Ministry of Justice. I looked for the police officers in charge of the case and I persuaded them to forward the case file to the ministry of Justice for prompt action. For those wrongfully sentenced to death, I re-investigated their stories and connected them with lawyers to file their appeal to the Court of Appeal and even to the Supreme Court until they get their freedom. For those whose cases had gone to the Supreme Court with proven evidence that they are wrongfully convicted, I personally wrote the Governor and the Board of Mercy and they were released

NNI: What are your achievements so far?
Guest: By the grace of God, CJMR has over 300 beneficiaries that have gone through our Halfway Home and over 200 beneficiaries of our legal intervention. His freedom was made possible as a result of our pressure on the Governor since 2008. He was sentenced to life imprisonment in 2009 but our further investigations revealed that the man did not know anything about the death of his girlfriend. We have over 5 people who have been set free from the death row as a result of our intervention.

NNI: Is there a Biblical history for human Rights?
Guest: God himself is a Human Rights Activist. God hates injustice as recorded in Proverbs 31: 8-9 "open your mouth and plead the cause of those appointed to death. Isaiah 58: 4-8 also says".... make your voice to be heard in the high Places, let the oppress go free.... You can see that God is a human rights activist. He want people to be fairly treated


NELOC News: What's your greatest challenge sir?
Guest: Challenges of getting adequate funding to mobilise the volunteers. Adequate funding to bring justice to the poor incarcerated. Adequate funding to even pay for the Halfway home which was due since. When you make appeal to the churches you will have little response. My greatest challenges is not money but people who can listen to my ideas so that those ideas will not die, government who will admit that there is error in the court proceeding which the affected poor whose rights have been denied should be given fair compensation. Definitely when you are treading unfamiliar terrain, not many people will like to go far with you. I strongly believe that when we get more individual who can reason that prisoner deserved attention we can have a better justice administrative and poor people can have access to Justice


NELOC News: What do you think about the concept of change sir?
Guest: Change is necessary when the former is no longer relevant and functional. Where old practices no longer bring positive results, there is need for a change. Change of clothes will be possible if a mad man can come to his senses that this cloths is no longer fit for him

NELOC News: How have you managed family with all these? Especially during your detention period?
Guest: I got married after my freedom. I got married on the 13th of December, 1997.


NNI: Can you share your Salvation experience?
Guest: Prior to my encounter, I had opened my mouth to deny the existence of God three times in my life. The first time was when I was much younger, at about 15 years. That afternoon I was in a prayer meeting with my parents. In those days at the CAC, there used to be observations of the hours of prayer. That day we were observing fasting and prayer, I just opened my eyes and I saw my dad sweating, praying, the voice just whispered to my ears "Why do people closed eyes in prayer? You open eye you cannot see God, you want to talk to him you have to close your eyes, don't you see that these people are foolish. Since that day Satan sew the seed of that rebellion thought in my heart. The Second time I was in an operation, it was during the raining and heavy thunder, fear gripped my heart, but after the rain stopped I went away with the goods, as I collected the money, the memory of the event flashed through my mind about three times, I said within me again "is there God? The third time was when I was in the prison. I have been reading the Bible, but I woke up one day to use the book of Revelation to clean my buttock, the reason why was any time I read the book of the Revelation I always have a bad dream, and moreover any questions that often arise in my mind I could not find any answers to those questions, one morning I ended up tearing the book to clean my buttock. After I finished the Revelation I turned on the book of Job, the reason was all the questions God asked Job there was no answer to them, I used the book of job to clean my buttock.

My salvation took place during my detention on August 16, 1989. I have been using the Bible to clean up my buttock because there was nothing to clean, many people used to tear their clothes to clean and many used the Bible to smoke. On 4th of August, 1989 I was still on the toilet while reading through the next chapter of the book of Job 40:1-14 before I used it to clean my buttock. While reading through, my conscience was struck. When those questions were directly to me

    “Should the one who is fighting the Almighty find fault with him? Let God’s accuser answer.” Job Acknowledges His Limitations. Then Job replied to the LORD. He said: “I must look insignificant to you! How can I answer you? I’m speechless.  I spoke once, but I can’t answer; I tried a second time, but I won’t do so anymore.” The LORD Continues to Interrogate Job.  The LORD answered Job from the wind storm and told him: “Stand up like a man! I’ll ask you some questions, and you give me some answers!  Indeed would you annul my justice and condemn me, just so you can claim that you’re righteous?  Do you have strength like God? Can you create thunder with a sound like he can?”  Can You Save Yourself?  “When you have adorned yourself with exalted majesty, clothed yourself with splendor and dignity, dispensed the fury of your anger, made sure that you have humbled every proud person, stared down and subdued every proud person, trampled the wicked right where they are, buried them in the dust together, and sent them bound to that secret place, then I will applaud you myself! I’ll admit that you can deliver yourself by your own efforts!”

I could not proceed to use the chapter to clean my buttock, but I needed to clean my buttock. So I decided to tear the book of Jude that day and I cleaned my buttock but shortly after that, a strange sickness struck me.

This was the point of my encounter with my maker. I was in a severe pain and headache for 3 days, whenever I want to pray the devil will bring the records of my sins to my memory, I will say within me "this sin is too much to be forgiving" I was Pilling it up in silence, I was in a severe pain and fever all of a sudden I exploded in tears, it was as if I saw the accuser with the records of my sin by my left side and I was standing before the judge waiting for the verdict but all of a sudden I busted into prayer asking Jesus to forgive me, the Bible says "though we do not know how to pray but the spirit interceding for us with groaning which cannot be explained"

You know I was in a cell with over 100 lucked up inmates, some of them came to me to comfort me, some were making jest of me but along the lines I slept off, that was around 2 pm and I woke up around 4 pm during the final counting, it was the noise of the crossing iron bar that woke me up but I couldn't get up to go out to be counted, when the wader came in he tab me to ensure I was not dead, I can hear someone telling him that "he is sick,". But before I was interrupted from my sleeping I had a dream I was in a class room, I saw a handwriting of the black board with these words

"Job - Jehovah
Jude - Jehovah
John - Jehovah - Jesus"

I was meditating on the dream before the warder came in to wake me up. When I lay again in meditation on the dream on what it meant, I came to sense that these three books are the books that I used to clean my buttocks. Then I heard a spirit conversing with my soul- The voice of the spirit in my soul.

What is the Alphabet letter that starts the name, Job?, I responded "J"
What is the name of God?, I responded "Jehovah"

In the same way he asked of the Alphabet of Jude and John in the same way I responded. The voice in a gentle manner asked me" what is the Alphabet letter that started with the name of Jesus? I said "J" all of a sudden my sense of understanding opened and I heard the gentle voice that said to me "there is no finger behind these books than the hand of I, Jehovah, Jesus"

The evening of the 16th of August, 1989 was the evening of my encounter with our Lord Jesus Christ. That night, I slept and I had a dream of seeing Jesus full of the circle of the moon, in the morning the man sitting by my side and a very good friend named Denis called me, he said he had a dream, as he narrated his dream lo and behold it was the same dream that I had. Subsequently, I had another dream where I saw the angels of God formed Jesus in every direction of heaven. Often time my common dream of fellowship in heaven is always on Friday night / Saturday morning.
This is my story of Salvation. Thanks for the refreshing of memories.
